TERMS AND CONDITIONS
Welcome to Jamaican Journeys by M & M! These terms and conditions (“Terms”) govern our relationship with you, the traveler (“Client”), in booking travel services. By planning travel with Jamaican Journeys by M & M, you agree to these Terms. Please note, we act as a booking agent for disclosed principal supplier tour operators, hotels, airlines, and other independent contractors (“Suppliers”) and are not the direct provider of travel services.
BOOKING AND RESPONSIBILITY
To book travel, you must be at least 18 years old and authorized to transact business with us. You are financially responsible for all bookings, ensuring the accuracy of the information provided. You agree to only make genuine reservations or purchases with us and our Suppliers, refraining from any speculative, false, or fraudulent bookings.
PAYMENTS, CANCELLATIONS, AND REFUNDS
You’re responsible for all charges, fees, and taxes arising from your travel bookings through us. By providing credit card details, you authorize us to purchase travel products on your behalf. Avoid filing disputes with your bank or credit card company, except in cases of fraud, to comply with booking terms and avoid cancellations or changes beyond our control.
Payment terms and cancellation policies of Suppliers apply to your booking. Failure to make final payments or violation of Supplier terms may result in reservation cancellations or denial of travel services. Cancellation requests must be sent in writing, subject to cancellation fees.
TRAVEL DOCUMENTS AND ENTRY REQUIREMENTS
You’re responsible for obtaining and carrying valid passports, visas, and required documents. TSA and DHS recommend carrying acceptable identification for boarding flights. Passport validity requirements and entry regulations vary; ensure compliance with respective country rules.
CONTRACTED ACCOMMODATIONS
While hotels are listed in your itinerary, Jamaican Journeys by M & M reserves the right to substitute alternative accommodations if necessary. We’ll make every effort to secure similar options, but no refunds are provided for such changes.
Please note that air-conditioning availability in hotels isn’t guaranteed and may be subject to local regulations. Its usage, especially at night or in the off-season, might be limited. Unfortunately, we have no control over hotel air-conditioning policies.
Room configurations may vary. While we aim to accommodate preferences like double-bedded rooms, specific room assignments are at the discretion of the hotel and not within our control.
INDIVIDUAL ENTRY REQUIREMENTS
Each country has distinct regulations regarding past criminal offenses. We advise contacting the relevant country directly for entry and exit requirements. Clients with criminal records should review specific entry requirements.
HAZARDOUS MATERIALS
Transporting hazardous materials is prohibited on flights. Please contact the airline representatives for specific details and exceptions.
HEALTH/IMMUNIZATIONS
Clients must possess necessary immunizations and health documentation as required. We do not assume responsibility for health or documentation accuracy.
AIR TRAVEL AND CHECK-IN
We are not responsible for airline schedule changes or departure taxes. Ensure timely check-in and reconfirmation of flight times to avoid issues.
RIGHT TO CORRECT ERRORS/AVAILABILITY
We reserve the right to correct errors or adjust prices. Offers and promotions are subject to availability and may change without notice.
UNUSED ARRANGEMENTS AND ALTERATIONS
No refunds are provided for unused portions of travel. Some tours require minimum passenger numbers; failing to meet requirements may result in surcharges or tour cancellation.
LIMITATION OF RESPONSIBILITY AND DISCLOSURE
Jamaican Journeys by M & M acts as a booking agent and is not liable for personal injury or property damage arising from services provided by Suppliers. We are solely compensated through commissions and fees.
SPECIAL NEEDS & PARTICIPATION REQUIREMENTS
Please disclose any special requirements or disabilities to Jamaican Journeys by M & M at the time of booking or as soon as they become known. Failure to provide this information might prevent us from accommodating you fully during the journey.
Regulations for accommodating disabilities vary by country, and Jamaican Journeys by M & M cannot be held responsible for services denied by airlines, hotels, or other independent suppliers.
Some activities and venues may have limited accessibility for those with mobility limitations. Many excursions involve walking on uneven surfaces or locations with limited wheelchair access.
It is your responsibility to ensure that the itinerary suits all participants. Contact us before booking to discuss available reasonable assistance.
While we will make reasonable efforts to accommodate your needs, we cannot guarantee this in every situation. Please note that some suppliers, such as hotels or small ships, may lack elevators.
No refunds will be provided for missed services due to your inability to fully participate unless these conditions are disclosed to us in advance. Our staff are not trained or required to provide personal assistance. If you require such assistance, we recommend traveling with a companion who can help with personal tasks.
Please inform us if you are traveling with a wheelchair or if this need arises after booking. You are responsible for storing and maintaining any permissible wheelchair. Additionally, motorized scooters may not be allowed in some destinations, and you will be responsible for arranging alternative transportation at your expense if you arrive with one.
RISKS/SAFETY
Travel involves varying degrees of risk. Stay informed of travel advisories and take precautions when traveling. Jamaican Journeys by M & M is not liable for any resulting costs, damages, or losses.
LIMITATION ON LIABILITY
International travel is governed by conventions and treaties that limit carriers’ liability. If a claim involves travel arrangements by carriers (air, sea, rail, or road) or hotel stays, our liability aligns with the maximum payable by these entities under relevant international regulations (e.g., Warsaw Convention for air travel, Montréal Convention, Athens Convention for sea travel).
Jamaican Journeys by M&M is not liable for damages, losses (including personal injury, death, or property loss), or expenses caused by Suppliers or any other individual. Suppliers are independent contractors, not our agents or affiliates.
All certificates and Trip Documents issued by Jamaican Journeys by M&M adhere to Supplier-specific Terms and Conditions, available upon request, and are subject to the laws of the countries where services are rendered.
FORCE MAJEURE
Events beyond our control may affect travel plans. We recommend purchasing travel insurance to protect against unforeseen circumstances.
CLIENT CONDUCT
Clients are responsible for any damage caused during travel. Adhere to behavior guidelines established by us and our Suppliers. Non-compliance may result in removal from tour facilities without a refund.
PHOTOGRAPHS
Photos taken during tours may be used on our website unless you opt-out.
CURRENCY FLUCTUATIONS
Prices may change due to currency exchange rate fluctuations. We are not responsible for foreign transaction fees imposed by banks.
TRAVEL INSURANCE
Travel insurance is highly recommended and may protect against financial loss due to cancellations or interruptions. Clients may decline insurance but must execute a waiver.
RESERVATION OF RIGHTS: CHANGES TO TERMS
We reserve the right to change these Terms at any time. Updated versions will be provided and are effective immediately upon posting.
GENERAL
These Terms are governed by Houston, Texas law. Any disputes will be resolved in Houston, Texas. If any part of these Terms is deemed invalid, the rest of the agreement remains in effect.
